IN THE MATTER OF A GRIEVANCE BEFORE THE GRIEVANCE SETTLEMENT BOARD BETWEEN: ONTARIO PUBLIC SERVICE EMPLOYEES UNION ("THE UNION") GEORGE KUDR~WATYCH ("THE GRIEVOR") AND THE CROWN IN RIGHT OF ONTARIO MINISTRY OF TRANSPORTATION ("THE MINISTRY") MEMORANDUM OF SETTLEMENT In full and final settlement of the above captioned grievance, dated December 20, 1991-, the parties agree without prejudice or precedent to resolve the matter on the following terms: 1. The Ministry shall create a new class standard which accurately reflects the duties and responsibilities oX the Grievor within one hundred and eighty days from-the date of receipt of the Union's execution of the Memorandum of Settlement. 2. The rate of pay in respect to the new classification shall be determined in accordance with the Collective Agreement. 3. The grievor shall be reclassified to the classification referred to in paragraph #1 (above) effective twenty working days prior to December 20, 1991. 4. Should any payment be made to the grievor in respect of retroactive wages pursuant to paragraph #2 (above) such payments shall bear interest calculated in accordance with the formula as set out in the Hallowell House case. 5. The parties agree that this settlement shall be made an order of the Grievance Settlement Board. - 2 - ONTARIO PUBLIC SERVICE EMPLOYEES UNION (George Kudrewat¥ch - grievor) AND MINISTRY OF TRANSPORTATION GSB File # 2815/91 6. The Grievance Settlement Board shall retain jurisdiction with respect to the implementation of this award. 7. ~ Upon fulfilment of the above terms of settlement, the grievance iS withdrawn.
