EMPLOYER Ministry of Correctional Services HEARING November 26, 1992 ~ . - - oi r The Agreed Statement of Facts provided by the parties is appended to this Award These facts were supplemented by the viva voce evidence of the grievor It was the grievor's evidence that the meals referred to in paragraphs six (6) and nine (9) of the Agreed Statement of Facts did not satisfy his nutritional requirements He testified that he did not consider the meals offered in those two (2) periods to be vegetarian in nat~re The grievor described the meals provided as a non-meat, high cholesterol, diet He stated that the failure to provide appropriate vegetarian meals continued until October 24, 1992 The grievor asserted that he was deprived of 148 meals prior to this date The Union sought compensation based on minimum meal allowance rates In my judgment, article 17 of the collective agreement is inapplicable to this dispute Quite clearly, the grievor did not Qualify for a meal allowance, or a meal, under either article 17 1 1 or 17 2 2 Qualification under those provisions is a precondition to the applicability of the exception referred to in article 17 7 I am unable to read this latter article as providing some independent right to the grievor It would seem that throu~h a long standing practice, employees such as the grievor have received duty meals This benefit is not extended pursuant to the collective agreement but is done as a matter of policy and practice Given the lack of a contractual obligation 1 ~ - " . ~. . to provide such meals, I am unable to conclude that the grievor may grieve against the Employer's failure to provide the preferred dietary regimen prior to October, 1992 A similar approach was taken by the Board in Union Grievance, 455/80 (Palmer) with respect to parking fees On the totality of the evidence, I find that apart from the period April 22 to May 15, 1992, the Employer has made a reasonable attempt to accomodate the grievor's dietary needs For all of the above reasons, the grievance is denied Dated at Windsor, Ontario this 15th day of December, 1992 /'rr). H-e.d M V Watters \ 2 ~ I .- - I GSB FILE NO 785/92 AGREED STATEMENT OF FACTS IN THE HATTER OF GRIEVANCE BETWEEN o P S E U (Dana Burrage) Grievor - AND - THE CROWN IN RIGHT OF ONTARIO (Ministry of Correctional Services) Employer 1 Mr Burrage is an employee of the Ministry of Correctional Services (MCS) at the Lindsay Jail as a Correctional Officer 2 He joined the OPS on December 5th 1977 2 The Correctional bargaining unit staff work three (3 ) rotational shifts Two (2 ) 12 hour shifts; 0700 hours - 1900 hours 1900 hours - 0700 hours and one (1) 8 hour shift, 0700 - 1600 hours 3 The Lindsay Jail through a long standing established practice provided 4 free meals per day to the Correctional Staff Breakfast, lunch and supper were provided to the 0700 hours - 1900 hours shift, one supper meal per staff member was provided for the 1900 hours- 0700 hours shift Staff on the 0700 hours - 1600 hours shift were provided 2 meals 4 The grievor was responsible for supervising inmates during his meal break As a result of having to eat at his post, the grievor was provided with a paid meal break and duty meal /2 ~; - i (2) 5 On February 22, 1992, the grievor provided the employer with a medical note from his doctor indicating that he was required to follow a lacto-ovo Vegetarian diet (Appendix 1) 6 At the time his request was presented, Ms K Gallow, the superintendent authorized the kitchen staff to substitute eggs and cheese for the grievor's meals 7 On April 22, 1992 the superintendent, on direction from the Regional Manager, suspended alterations/ substitutions to meals served to staff (Appendix 2 and 3) 8 On April 27, 1992 Mr Burrage grieved that the employer did not provide the meals that met the requirements of his diet 9 On May 15, 1992, the superintendent, in response to direction given by the Assistant Deputy Minister, advised the kitchen staff that employees, who requested a vegetarian meal, would be provided one Furthermore, the superintendent indicated in her correspondence that Mr Burrage and Mr Goden (Kitchen Manager) would be developing a rotating vegetarian menu (Appendix 4 and 5) 10 On July 27, 19~2, the superintendent advised all staff that the breakfast meal would no longer be made available, effective July 28, 1992 (Appendix 6) <!>~ -~ ~ NOV 24 '92 16:51 LINDSA'r JAIl, '- P 1 APPENDIX 1 I' , -, ., I . ., ._\.:.....--.~...;;..-."..- ....-.._--=-& . ..J..'" - , -...
