MEMORANDUM OF SETTLEMENT
BETWEEN ~
ONT ARlO PUBLIC SERVICE EMPLOYEES UNION
("The Union ")
-AND.
THE CROWN IN RIGHT OF ONTARIO
(Ministry of Environment and Energy)
("The Employer")
Re Douglas Spry ("The Grievor")
Without precedent and prejudice, the parties hereto agree to the following terms as
full and final resolution of the classification grievance of Douglas Spry dated
June 22, 1992
-
1 The 'Ministry agrees to reclassify the grievor's position to the Scientist 4
level effective from January 1, 1992.
2 The Ministry will pay to the grievor all retroactive amounts owing including
interest which will be paid on the basis of the formula determined in the
decision of the Ontario Labour Relations Board in Hallowell House, less
statutory deductions, within sixty (60) days of the date of the signing of this
settlement.
3 The Union and the Grievor agree that the grievor's duties and responsibilities
are accurately reflected in the position description dated June 1, 1992, and
agree the level of Scientist 4 is the appropriate classification of the position
4 The 'Union and the Grievor agree to withdraw the grievance
5 The Parties agree that this Memorandum of Settlement shall be made an
Order of the Grievance Settlement Board
