( :J GSB File No. 1919/92 OPSEU File No. 92F705 -- IN THE MATTER OF AN ARBITRATION BEFORE THE GRIEVANCE SETfLEMENT BOARD -.- --- BETWEEN DANVER AMBULANCE SERVICE INC. t J (the "Company") - and - ONTARIO PUBLIC SERVICE EMPLOYEES UNION, and its LOCAL 256 (the "Union") MINUTES OF SETfLEMENT In the matter of a grievance filed on behalf of Loren Langley (the "Grievor") and dated September 22, 1992 - GSB File No. 1919/92 - OPSEU File No. 92F705 (the "Grievance"); Without precedent and without prejudice to any other matter between the parties, and without admission of liability on the part of any party, the parties hereto agree to settle the Grievance on the following bases. 1. The Grievor will be awarded a full-time Ambulance Attendant position. I 2. Her full time seniority date shall be October 4, 1992. It is agreed that she shall follow Santo Pasqua on the full-time seniority list. 3 Her rate of pay and eligibility for benefits shall match such rate and eligibility for Santo Pasqua, effective January 1, 1995 Prior to January 1, 1995, her pay and benefits shall be as a part-time employee. 4 The Grievor will be scheduled to full-time hours effective January 1, 1995 Prior to January 1, 1995, the Grievor will coqtinue to be scheduled as a part-time employee. 5 The Grievor shall be eligible to vacation benefits as a full-time employee effective April 1, 1995, but not before. For vacation year April 1, 1995 to March 31, 1996 only, her vacation pay shall be calculated on the basis of 4% of her earnings from employment with the Company for the period January 1, 1995 to March 31, 1995, notwithstanding the provisions of Article 14 of the collective agreement, but the ~ , ( i\.< " - 2;. Grievor shall have the right to take up to two weeks unpaid leave for that year, in accordance with the practices applying to other full-time employees. Thereafter, her vacation entitlement will be calculated in accordance with the collective agreement. Prior to January 1, 1995 she will continue to receive 4% of her earnings a~ vacation pay in accordance with the rules of part-time employees. 6. The Grievor will not receive any compensation for lost wages or benefits arising out of this Grievance or by virtue of full-time status for any period prior to her commencement of employment as a full-time employee on January 1, 1995 7 The scheduling of hours ofwqrk for the Grievor for the month of January, 1995 shall be negotiated by the parties, with the understanding that the Grievor shall be placed on the regular 10 week rotation as soon as possible and in any event by January 15, 1995 8. The Company agrees to submit a proposed schedule for the Grievor for the month of January, 1995 to the Union by December 2, 1994 9 The foregc;>ing represents full and complete settlement of the Grievance and any and all other grievances or causes of action the parties may have that arise from the job competition run by the Company for full-time positions in August and September of 1992. 10. The parties agree that these Minutes are to be endorsed as an Order of the Grievance Settlement Board. Dated at Toronto this 24th day of November, 1994 For the Union For the Company Loren Langley ~ y
