Marvy EMPLOYER Counsel Legal Services Branch Ministry of Community & social SerVices HEARING January 7, 1994 ---- l~ . ~ ,~ ..t';';; I -, ---". ff ''j' 2' DECISION The Board was seized with ten separate grievances, all filed by thegrievor, Mr. Peter Dirks At the commencement of the hearing, Mr. Paul for the union advised the Board that the union had withdrawn six of the ten grievances. These were OPSEU grievance file numbers, 93B486, 93B487, 93B698, 93B699, 93B700 and 93B710. The' union indicated its desire to proceed with the remaining four grievances being OPSEU grievance file numbers 93B484, 93B485, 93B697 and 93B701. Following opening statements, by both counsel as to their respective positions on the grievances the parties executed the following Memoran~um of Settlement: M~ORANDUM OF SET';l'LEMENT Grievance Settlement Board # 246/93, 680/93, 684/93 In thematte~ of the g~ievancebetween OPSEtJ on behalf of Peter Dirks and The Crown in Right of Ontario as represented by HCSS The parties hereto agree to the following terms as full and final settlement of all matters in dispute pertaining to the above captioned grievances: It is understood that the grievor's requests to work at home on Jan. 22, or Jan. 25, 1993, January 28, and Feb. 1, 1993, March 10, 1993 and March 22, .. (I) - \. -::......... J ~! 3 ./ 1993 were denied by his supervisor The supervisor did not review the requests against operational requirements. It is further understood that these denials were unreasonable and were a Breach of the Memorandum of Settlement 1289/92'.
