'ce-Chair ----- -- 't \!.'!l' Memorandum of Settlement The Parties agree and acknowledge as follows without precedent or prejudice in unrelated matters: The Employer agrees 1 to place the grievor on leave of absence without pay effective August 17, 1996 and to grant the grievor a record of employment pursuant to Article 42 4; 2 that the grievor's seniority will continue to accumulate during this leave; 3 to pay grievor under the short term sickness plan and provide a top up to 100% of salary and benefits from January 9, 1997 until June 1, 1997 which i~ a total of 102 working days; 4 that the grievor will return to work on June 2, 1997 with full salary and benefits; 5 having regard to the circumstances the employer could not { allow the grievor to return to work without further medical evidence until January 9, 1997; 6 that the grievor may purchase back pension for leave of absence and strike periods; 7 the grievor will return to work on the 8 hour scheduled shift currently in place with the option of transferring to the compressed work week schedule in compliance with past practice; 8 to provide the grievor with one week of orientation for the first week of his return; 9 to deduct and pay Employment Insurance benefits to the Receiver General for the period of ,January 9, 1997 to June 1, 1997 from the money being paid under paragraph 3; 10 that the Ministry average for attendance credits is 9 5 attendance credits per year; The grievor agrees; 1 that his use of attendance credits between June 2, 1997 and November 30, 1998 shall not exceed 14 25 attendance credits in that period, ;, T'i} In consideration of the above the grievor and the union hereby withdraw all outstanding individual applications, Human Rights Compaints and grievances of Mr. Couture, as fully and finally settled, including but not limited to OLRB file #'s 1125-96-0H and 1516-96-0H and GSB #'s 1435/93, 1438/93, 2166/93, 1761/95, 1762/95, 972/96 and 2125/96 DATED at Toronto, this 30th day of May, 1997 ~1~ ;:;.a ~ ?v lLc/VY' I> (t:) <JrJ I'td' - N,( -;?;;"..........ci"S"" rtJR.1l1E e" {J/..OYE'l --- -- --
