Thorup EMPLOYER Counsel Filion, Wakely & Thorup Barristers & Solicitors HEARING April 8, 1994 \ j ( (' .- ---.....-...- ,. 2 \.. €' - ~ Introduction " By two grievances dated May 18, 1993, Karen Fournier, a Sign Painter Improver employed by the Ministry of Transportation, grieves that she has been discriminated against and harassed in the workplace These two grievances proceeded to a heanng in Toronto at which time a number of preliminary issues were raised For the convenience of the' parties, and at their request, the following sets out in writing the Board's disposition of the preliminary issues in dispute 1 The parties are directed to disclose to each other, in advance of the next scheduled hearing date, all relevant documents. It is understood that certain documents relating to the attempted settlement of the gnevor's human rights complaint are not subject to this order It is also understood that the use of these documents by either of the parties during either the pre-hearing process, or during the hearing itself, is by order of the Board ---- 2 The union is directed to provide the employer with particulars underlying both of the grievances 3 The employer is directed to respond to these particulars by Indicating ./ acceptance, disagreement or any alternate facts or explanation It is ( understood that the employer's response will be based on information obtained from members of management. 4 The union and the employer are directed to provide the members of the Board with copies of these particulars in advance of the next scheduled date I ( ( .- 3 !fo -,......~ 5 The employer is directed to advise the follOWing persons of these I proceedings and of the fact that they may have the nght to participate in these proceedings either alone or represented by counsel Frank Babiak Rod Bishop Wayne Johnson Robert Lisenchuk Scott McCallum The employer is further directed to provide each of these persons with a I copy of this award j 6 The Board directs that witnesses be excluded from this hearing 7 The hearing will reconvene in Thunder Bay on November 3, 1 994 DATED at Toronto this 5th day of May, 1994 /// '- ---- ---------------- William Kaplan Vice-Chairperson 11t -4- --- ------- P Klym Member ~~J ..J F-Col ------- Member \
