HEARING October 17, 1994

The hearing in this matter convened on October 17, 1994. During the course of the
?
hearing the parties resolved the matter and requested that settlement be issued as an
order of the Board. Accordingly, the Board orders the following'
Memorandum of Settlement
The parties agree to settle the above-noted grievance without prejudice and without
precedent:
1 The grievance is hereby withdrawn;
2. The employer shall pay the grievor the equivalent of 6 weeks pay at the applicable
rate for a Merchandiser 2 employed in the Upper Canada Village Store, less
statutory deductions, and will credit the grievor with seniority for the period;
3. The employer shall issue the grievor a New Record of Employment which credits
the grievor with seventeen (17) weeks of employment and which includes no more
than three (3) weeks prior to June 24, 1994,
4. Such Record of Employment shall be issued on cr before October 19, 1994,
5. The grievor shall be recalled to employment in the future, in accordance with the
collective agreement.
This matter was duly signed by representatives of the employer, the union and by the
grievor
