MEMORANDUM OF SETTLEMENT
BET WEE N
ONTARIO PUBLIC SERVICE EMPLOYEES UNION
( OPSEU)
- and -
THE CROWN IN RIGHT OF ONTARIO
as represented by
MANAGEMENT BOARD OF CABINET
(MBS) the Employer
WHEREAS the Union filed a grievance dated June 17, 1994 alleging a
violation of Article 53 and Article A of the Collective Agreement
between the parties,
AND WHEREAS the issues raised in the grievance were the subject of
argument and decision in GSB File No 1642/1990
AND WHEREAS by letter dated August 18, 1994 Management Board
Secretariat agreed with OPSEU that certain reasoning in the
aforesaid decision should be applied to all bargaining unit
employees in the Ontario Public Service effective March 19, 1992;
Therefore the parties agree and acknowledge as follows
1 Where an employee is on LTIP, the time of retirement
their severance payment under Article 53 shall be
calculated based on the salary that they would have
received had they been working up to their time of
retirement if their retirement occurred on or after March
19, 1992
2 The foregoing is full and final settlement of this issue
3 Parties request the GSB issue a declaration incorporating
the foregoing agreement as a final order in this matter
