Milich Member FOR THE R Haggett GRIEVOR Staff Representative Ontario Public Service Employees Union FOR THE C Marchand EMPLOYER Ministry of Labour GSB# 1515/94 OPSEU# 94F361 & 94F363 BOARD ORDER Attached is the Memorandum of Settlement which the parties agreed would be made an Order of the Board. , DATED at Toronto, this 22nd day of February, 1995. ~ ~~oWeS-BUgd:n. 4f~~LfM~ MEMORANDUM OF SETTLEMENT Between The Crown in the Right of ontario The Ministry of Labour (The Employer) and The ontario Public Service Employees Union (The Union) and Ms Namita Walia-Nault (The Grievor) In the matter of two Article A grievances filed by the Grievor and the Union on April 8 and 20, 1994, without prejudice or precedent, the aforementioned parties agree to the following terms as full and final settlement: The Employer 1. Recognizes its obligation under Article A 1 2 to provide an environment free from discrimination or harassment practiced by reason of an employee's activity in the Union, and confirms that there has been no intention to violate the grievor's right in that respect 2 Acknowledges that information made available to the ministry by the parties during the grievance process, confirms that Ms. Jardine, on more than one occasion, acted in an inappropriate manner in her dealings with the grievor. 3. Agrees to ensure that Ms. Jardine will not directly or indirectly supervise nor evaluate the grievor and that the grievor will be under no obligation to deal directly with Ms. Jardine, except for emergency situations. The Grievor and the Union 4 Agree to withdraw the aforementioned grievances and any current and future actions in regards to this matter, with any Boards, commissions, Tribunals or Government Agencies. 5.
