GSB# 555/95/ 556/95/ 712/95 OPSEU# 95B984, 95B985, 950081, 950082 BOARD ORDER Attached is the Memorandum of Settlement which the parties agreed would be made an Order of the Board DATED at Toronto, this 23rd day of November, 1995 /;?/ ---------- W Kaplan, Vice-Chairperson -- Memorandum of Settlement Between Adult OccupatIOnal Ce ntre Edgar - and - OPSEU, Local 321 (Gnevances of Sears and Shuttleworth) In full and final settlement of the two gnevances dated -April 24, 1995, GSB #0555/95, 0556/95 and the two grievances, Shuttleworth, May 8, 1995 and Sears, May 11, 1995, GSB # 0712/95, the oartles agree to the follOWing 1 The employer acknowledges, as provided for In ArtIcle A 1 2 of the Collective Agreement, that "there shall be no dlscnmination or harassment practIsed by reason of an employee's membership or activity in the union" 2 The employer commits to abide by Article A 1 2 of the Collective Agreement and further confirms that it will take no retaliatory actIon against either of the grievors for union actiVIty now or In the future 3 The employer acknowledges that it has the responsibility, when adVised by the union, union members, or anyone else, of the posSIbility of a VIolation of the WDHP or Article A, to take such immediate investigatory action as may be appropriate and to take all appropnate remedial steps 4 The employer acknowledges In the circumstances of thiS case that It was adVised by Mr Sears and Mr Shuttleworth of certain alleged , Violations of Article A and/or the WDHP but failed to take all appropriate 2 action as It was required to do Moreover, the employer expresses Its regret for Its dIsclosure of certain information received by It In confidence and undertakes to ensure that this mistake is not repeated In addition, the employer acknowledges that t:le grievors, In their capacIty as union officials, were exercising their role by bringing these concerns to the attention of management. S The employer and the union mutually acknowledge that they both have the responsibility for ensunng a harassemclt-free workplace 6 The employer will, within ninety days of the signing of these Minutes of Settlement, provide a training course, of at least one day's duration, on management and union responsibilities with respect to ArtIcle A and the WDHP ThiS course will be attended by the Administrator, Assistant Administrator, and Director of Human Resources The union undertakes to send at least two members of the executive, two stewards and one member of the Health and Safety Committee to the course, and both grlevors 7 The provIsion and agenda of the course shall be the subject of immediate diSCUSSion between the parties In the ERe 8 If the parties are unable to agree on the course provider and agenda, that matter shall be referred to WillIam Kaplan In a process of final offer selection 9 Both partIes commit, henceforth, to work together In a Spirit of cooperation and good will as they go about addressing the issues covered . 3 by these Minutes of Settlement 10 A typed copy of these Minutes of Settlement will be posted In the workplace for ten days 1 1 These Minutes of Settlement can, at the request of eIther party, be made an order of the Board 12 The parties request that Wilham Kaplan remain sel7ed with respect to these Minutes of Settlement DA TED at Toronto this 15th day of November 1995 "R Sh uttleworth" "L Clllls" --------------~------- ---------------------- "A Sears" "s Gilchrist" ---------------------- ---------------------- "Jim Paul" "M Gottesman" -------------------- ---------------------- & lV I fV\ e v~ u /~ ~J\~ ----- I '" \::' \1\" /~ e ., + '-..-, .......
