DeCISIOn
The PartIes agreed to and partIcIpated In a mediatIOn/arbItratIOn process In accordance
wIth ArtIcle 22 16 of the OPSEU CollectIve Agreement on July 25 2000 wIth respect to
three outstandIng gnevances filed by the gnevor dated November 1 1995 November 29
1996 and October 26 1999 The partIes agreed that I had the jUnSdIctIOn to deal wIth thIS
matter and they consented to my ISSUIng thIS order wIthout reasons, In order to provIde
full and final settlement of the aforementIOned gnevances The partIes agree that my
decIsIOn In thIS matter IS made In accordance wIth ArtIcle 22 16 7 of the CollectIve
Agreement and IS wIthout precedent or prejUdICe
ThIS matter Involves two separate gnevances between Mr Rohrmoser and two members
of management. Once IncIdent occurred In 1992, the other In 1999 A thIrd gnevance
deals wIth a retroactIve payment paid to Mr Rohrmoser by the employer In 1996
Based on the submIssIOns of the partIes, my Informal dIscussIOns wIth the partIes dunng
the medIatIOn/arbItratIOn process, and the InfOrmatIOn brought forward by the gnevor I
have determIned that I am wIthoutjunsdIctIOn to hear these matters For the purposes of
thIS determInatIOn, I have assumed that the InfOrmatIOn brought forward by the gnevor IS
entIrely accurate The gnevances are hereby dIsmIssed.
