AWARD
The partIes havmg entered mto a medIatIOn-arbItratIOn process and upon consIderatIOn of
the eVIdence presented and the submIsSIOns of the partIes m thIS matter the Board makes the
followmg order
1 The Employer IS to pav to Ms Lmdsay the amount of $500 OO/month effectIve September,
1997 for as long as Ms Lmdsay remams qualIfied for L TD benefits, subject only to
deductIOns reqmred by law for L TD benefit payments,
2 The arrears m the amounts to be pard to Ms Lmdsay as descnbed above for the penod
between September, 1997 and June, 1999 In the amount of$10,500 00 shall be pard to Ms.
Lmdsay wIth mterest at 5% per annum calculated m accordance WIth the Hallowell House
formula In the amount of $462 77, subject only to deductIons reqUIred by law;
3 In the alternatIve to the payments descnbed above, and at the Employer s optIOn, the
Employer shall pay a lump sum payment to Ms Lmdsay m the amount of $125 000 00,
subject only to deductIOns reqmred by law and deductIOns for any amounts otherwIse pard
out to Ms Lmdsay pursuant to thIS order;
4 The regular payments of $500 OO/month as descnbed m paragraph 1 above must be
commenced wIthm 4 weeks of the date OfthIS order and the arrears WIth mterest descnbed
m paragraph 2 above must be pard to Ms Lmdsay wIthm 4 weeks of the date of thIS order;
and
5 If the Employer elects to pay the lump sum amount described m paragraph 3 above, the
i payment shall be made wIthm 8 weeks of the date of thIS order
