ThIS gnevance Involved a dIspute over whether the Employer had the
unIlateral nght to create a new ShIft when dIrected to do so by the MinIstry
of Health, the agency whIch funds the ambulance servIce
The partIes used the med/arb process and were able to achIeve a
settlement of all of the schedulIng Issues, but could not reach agreement on
the compensatIOn Issues I therefore heard from the partIes on the Issue of
compensatIOn and arbItrated that sole Issue
The resolutIOn of thIS case, combInIng both medIated and arbItrated
Issues, IS as follows
1 ArtIcle 17 03 of the CollectIve Agreement IS amended by addIng the
follOWIng 8 hour ShIft
10 30 am to 6 30 pm
2 Manlyn Coulombe, one of the employees affected by thIS change, shall
receIve the sum of $1,000, less statutory deductIOns, as compensatIOn for
havIng preVIOusly worked a ShIft not contaIned In the CollectIve
Agreement. ThIS amount shall be paId by May 13, 1999
3 Frank Lapensee, one of the employees affected by thIS change, shall
receIve the sum of $1,000, less statutory deductIOns, as compensatIOn for
havIng preVIOusly worked a ShIft not contaIned In the CollectIve
Agreement. ThIS amount shall be paId by May 13, 1999
4 Manlyn Coulombe shall have the nght, untIl Apnl 21, 1999 to exerCIse
her senIonty and bump the most JUnIor employee workIng a 12 hour ShIft
at the TImmInS Base
5 Frank Lapensee, shall have the nght, untIl Apnl 21, 1999 to exerCIse hIS
senIonty and bump the most JUnIor employee workIng a 12 hour ShIft at
the TImmInS Base
