ORDER
The UnIon apphed for an adJournment of the heanng scheduled for June 19
and 20 ThIS apphcatIOn led me to dISCUSS wIth the partIes the general matter
of scheduhng and adJournIng dates In thIS matter As a result of those
dIscussIOns, the partIes agreed to a number of heanng dates In the months of
September 2001 through January 2002 Based upon my dIscussIOns wIth the
partIes, I make the folloWIng dIrectIOns about the dates now scheduled for
thIS case and any dates scheduled In the future
1 Scheduled dates shall have no effect on the assIgnment of the
gnevor to tnals NeIther party shall Inform the person responsIble
for tnal assIgnments of any scheduled date untIl after the
assIgnment of a tnal whIch creates a conflIct WIth that date
2 The gnevor shall be granted leave from work on the scheduled
dates
3 The grantIng of such leave shall not effect her contInuIng
assIgnment to a tnal from whIch she has taken leave
4 The UnIon shall not seek the adJournInent of any scheduled date In
order to allow the gnevor to work as a court reporter
5 The Employer shall not seek the adJournment of any scheduled
date In order to allow the gnevor or any employee wItness to work
as a court reporter
6 If any tlurd party asks the UnIon or the Employer to seek an
adJournment, the UnIon or Employer wIll refer the thIrd party's
request to the RegIstrar of the Gnevance Settlement Board and
take no posItIOn as to whether the adJournment should be granted.
7 The heanng scheduled for June 19 and 20 IS adJourned.
