Harris Vice-Chair FOR THE GRIEVOR Ed Holmes Counsel Ryder Wright Blair & Doyle Barristers & Solicitors FOR THE EMPLOYER John Brookes Goodman Phillips & Vineberg Barristers & Solicitors HEARING June 11, 2001 BOARD ORDER Having heard the submissions of the parties at the mediation-arbitration hearing held In Toronto on June 11, 2001, the Board orders as follows GRIEVOR GSB NO OPSEU NO Union 1921/99 00E022 Bate 1 922/99 00E023 Bridgewater 1923/99 00E024 Glover 1924/99 00E025 Pietras 1 925/99 00E026 Urle 1 926/99 00E027 Wright 1927/99 00E028 Benn 1 929/99 00E029 Union 01 39/00 00E122 Whereas, the Grlevors/Unlon filed the grievances noted above which are variously dated January 6,7, 14,27,2000 and March 29,2000 (the "Grievances"), and, Whereas the Parties wish to resolve all matters raised by the Grievances, on a without preJudice and precedent basIs NOW THEREFORE, the Parties agree to the follOWing term/and conditions as full and final resolution of the Issues raised In the Grievances 1 Upon delivery of payment to Equitable Life In the follOWing amounts subJect to paragraph 2 here of from each of the Individual Grlevors and upon being adVised of receipt of such payment by Equitable Life, the Employer Will remit a matching Employer contribution to the pension account of each grlevor' Steve Bate 258 90 Amy Benn 1219 48 Derek Bridgewater 1647 33 Kim Glover 2058 94 Nick Pietras 644 17 Sue Wright 662 24 Glenn Urle 137571 Peter F orsey 71 7 00 2 2 The Grlevors specifically acknowledge and agree that the total amount due pursuant to paragraph 1 here of may be reduced by employee and employer contributions due and to be made by the Employer with respect to December, 2000 and January, 2001 pension remittances 3 On or before June 18, 2001, counsel to the Employer shall advise counsel to the union of the amount of such December, 2000 and January, 2001, rem Ittances and the total net amount due pursuant to paragraph 1 shall be reduced accordingly 4 The net amounts then required to be paid by the Grlevors shall be delivered by the Grlevors to Fran Adams at Equitable Life on or before June 30, 2001, failing which there shall be no obligation of the Employer to make any payment with respect to an Individual Grlevor who does not make such payment as required herein 5 The net payment then required to be paid by the Employer shall be delivered to Equitable Life upon being advised by Equitable Life of the payment by the Grlevors and within the time required by the Pension Benefits Act (Ontario) and not later than July 31, 2001 6 The Parties acknowledge and agree that the payments made pursuant to paragraphs one and two here to are made In respect of the calendar years 1999, 2000, and 2001 The Union and the Grlevors agree to withdraw the above captioned grievances and no further or other grievances will be filed regarding any pension entitlements alleged to be due regarding period, prior to 1999 Dated at Toronto, this 13th day of June, 2001 '\ . .. - . ,.. .
