(416) 326-1396 GSB #1252/00 OPSEU#00UI48 00U149 00U150 IN THE MATTER OF AN ARBITRATION Under THE CROWN EMPLOYEES COLLECTIVE BARGAINING ACT Before THE GRIEVANCE SETTLEMENT BOARD BElWEEN Ontario Public SelVice Employees Union (Union Grievance) Grievor -and- The Crown in Right of Ontario (MinistlV of the Solicitor General and Correctional SelVices) Emplover BEFORE Richard Brown Vice Chair FOR THE David Wright, Counsel GRIEVOR Ryder, Wright, Blair & Doyle Barristers and Solicitors FOR THE Len MalVY Counsel EMPLOYER Legal SelVices Branch Management Board Secretariat HEARING JanualV 22, 2001 FebrualV 5 2001 FebrualV 16 2001 ORDER WHEREAS THE PARTIES wish to erter into a full and final settlement of the community escorts issues arising out of the above referenced grievances and the OLRB decision #2094- OO-U THE PARTIES HERETO agree to the following MINUTES OF SETTLEMENT 1 Twelve (12) correctional officer positions will be removed from the CNCC RFP 2 The following process will be used to determine those seven (7) correctional officers at Guelph, two (2) officers at Burtch, one (1) officer at Parry Sound, and two (2) officers at Barrie, who will be removed from the CNCC RFP a. In descending order of seniority correctional officers at the four respective facilities will choose whether they wish to be excluded from the RFP b These choices will be offered on March 1 f}h and the employees will have three (3) working days to decide In default of an election, they will remain on the CNCC RFP 3 Those who choose not to be included in the CNCC RFP will be surplussed and have full access to article 20 rights pursuant to the collective agreement. 4 In resolution of the issues with respect to CNCC pursuant to OLRB Board decision #2094-00-U the parties have agreed that it is not required that public servants who are members of OPSEU's bargaining unit perform community escort work to and from CNCC For greater certainty, from the date of this order, the provision of community escort work at CNCC will be determined by the employer in its sole discretion 5 The parties agree that this settlement shall be made an order of the Grievance Settlement Board 6 Vice Chair Brown is to remain seized of any problems with the interpretation or implementation of this Settlement.
