ORDER
HavIng heard the submIssIOns of the partIes, the Board orders as follows
1) Dr Byron Hyde IS hereby ordered to produce Mr Mann's medIcal records relevant to
andlor consIdered In connectIOn wIth the preparatIOn of hIS report of September 21 2002
2) Dr EmIl Gngore IS hereby ordered to produce Mr Mann's medIcal records relatIng to hIS
capacIty to voluntanly execute bIndIng legal documents as at March 26 2001 whether the
records were created or obtaIned before or after that date
3) Counsel to the Umon IS hereby ordered to commumcate the orders aforeSaid to the
IndIVIduals named, receIve the documents and forward the same to Ms MUIJI CopIes of
the documents may be retaIned for the Umon's use In these proceedIngs
4) The Umon IS hereby ordered to provIde to the Employer no later than December 20 2002,
full partIculars of the Umon's case, as requested and as set out In Counsel to the Employer's
correspondence of August 9 2002
5) The Employer IS hereby ordered to respond to the Umon's partIculars, no later than January
3 2003 wIth partIculars of the Employer's case
6) The partIes are to exchange any and all documents upon whIch they Intended to rely no
later than January 10 2003
7) It IS hereby ordered that any and all medIcal records affected by thIS order be and the same
are hereby ordered to be treated In confidence and used solely for the purposes of thIS
lItIgatIOn.
8) The heanng Into the ments wIll commence January 20 2003 at 10 00 a.m
