DeCISIon
The partIes referred the above-captIOned Job competItIOn/dIsCnmInatIOn gnevances to
medIatIOn/arbItratIOn In accordance wIth ArtIcle 22 11 and AppendIx 2 of the CollectIve Agreement.
At the outset of the heanng, the partIes agreed that I had JunsdIctIOn to deal wIth thIS matter and they
requested that I Issue a "wIthout precedent" decIsIOn wIth no reasons
HavIng carefully revIewed the submIssIOns of the partIes, the gnevances are allowed to the extent
outlIned below'
1 The employer IS dIrected to appoInt the Gnevor to the posItIOn of "C" Store Manager Store #
302, Mount Forest, effectIve June 2,2003 In thIS regard, the employer shall pay the gnevor at
the 2nd step of the salary and classIficatIOn schedule for "C" Store Managers whIch IS
$24 13/hour
2 ThIS decIsIOn hereby resolves all outstandIng claims, gnevances or actIOns the gnevor may
have agaInst the employer wIth respect to the events and CIrcumstances gIVIng nse to the above
captIOned gnevances and
In the event that the partIes have any dIfficultIes ImplementIng thIS decIsIOn, I shall remaIn seIzed.
