DeCISIon
The partIes referred the above captlOned gnevances to medlatlOn/arbltratlOn In accordance wIth
ArtIcle 22 11 and AppendIx 2 of the CollectIve Agreement. The gnevors In thIS matter allege
that the employer has vlOlated artIcle 21 of the collectIve agreement by not replacIng staff
transferred from one store to another store wIthIn the same geographIcal area. At the outset of the
heanng, the partIes agreed that I had jUnSdlctlOn to deal wIth thIS matter and they requested that I
Issue a "wIthout precedent" declslOn wIth no reasons
HavIng carefully revIewed the submlsslOns of the partIes, I have concluded that there IS no
vlOlatlOn of the collectIve agreement. AccordIngly the gnevances are dIsmIssed.
