DeCISIon
The partIes referred the above captlOned gnevance to medlatlOn/arbltratlOn In accordance wIth
ArtIcle 22 11 and AppendIx 2 of the CollectIve Agreement. The gnevors In thIS matter allege
that the employer vlOlated artIcles 6 and 38 of the collectIve agreement WIth respect to the
staffing complement utIlIzed by the employer on July 2, 2001
At the outset of the heanng, the partIes agreed that I had jUnSdlctlOn to deal wIth thIS matter and
they requested that I Issue a "wIthout precedent" declslOn wIth no reasons
HavIng carefully revIewed the submlsslOns of the partIes, I have concluded that there IS no
vlOlatlOn of the collectIve agreement. AccordIngly the gnevance IS dIsmIssed.
