Order
The instant policy grievance lS scheduled for hearing on
October 4, 2004 By letter dated September 21, 2004 the union
requested an order for pre-hearing production pursuant to s
48 (12) (b) of the Labour Relations Act The employer opposed
this request In the alternative, the employer submitted that
any order issued should be restricted to data covering the year
2000 and after
The parties submitted a serles of correspondence that had
been exchanged, together with their written submissions and
legal authorities
Having reviewed the same, the employer lS ordered to
produce to the unlon the information requested by the unlon, no
later than 5 00 P m on Thursday September 30, 2004
Considering, inter alia, the timing of the union's request, the
order lS restricted to the information coverlng the year 2000
and after If, after revlewlng that information, the unlon
decides that it ought to recelve production of the information
relating to prlor years, a further request may be made at the
hearing The Board would requlre further information and
submissions before ruling on any such request, if one is made
