Decision
To expedite the hearing in this matter, I make the following orders:
1. The grievor shall provide to the employer a psychiatric opinion describing in detail
the nature of any restrictions on his ability to perform jobs within the Ontario Public
Service. This opinion should identify any duties the grievor cannot perform and any
settings in which he cannot work.
2. By October 31, 2006, the employer shall provide to the union a draft list of questions
to be answered by a psychiatrist along with a list of three psychiatrists and the earliest
appointment available with each. If possible, one of them shall be in the Durham
Region.
3. The union shall respond by November 14, providing any comments on the questions
and identifying the grievor's choice of psychiatrist.
4. The psychiatrist chosen shall be asked to answer the questions in writing within two
weeks of meeting with the grievor.
The hearing dates of October 24 and 25 are adjourned. New hearing dates will be set after the
date of the grievor's appointment with a psychiatrist is established.
