Decision
At the commencement of the hearing in this matter, Mr. Wright, counsel for the Union, raised
concerns that had been expressed by the grievors about a perceived apprehension of bias on my
part concerning a major participant in these proceedings. The Union asked for an adjournment
of that day and the following day in order to seek instructions about whether it would bring a
motion to have me step down as Vice-Chair.
Mr. Heath, counsel for the Ministry, agreed to the adjournment but wanted it recorded that it did
not consent and that the adjournment was conditional on a Board order requiring the Union to
provide particulars of its claim by February 2, 2007.
Therefore it is the Order of this Board that the Union deliver to the Employer by February 2,
2007, the particulars it intends to rely on in support of its motion.
