Decision
These grievors in this group grievance were all classified Youth Services Officers at Sprucedale
Youth Centre in the Ministry, when they grieved December 12, 2004 that they had not received
proper pay when they began work at the institution. On March 27,2007, the parties referred
Scheffel et al. to mediation-arbitration in accordance with Article 22.16 of the Collective
Agreement. The employer took the position that the grievors had no entitlement to be paid at a
higher classification when they began their positions under the collective agreement.
At the outset of the hearing, the parties agreed that I had the jurisdiction to deal with this matter
and they requested in accordance with Article 22.16, that I issue a without prejudice decision,
with no reasons.
Having carefully reviewed the submissions of the parties as well as the jurisprudence of the
Board, I hereby deny the grievance.
