Decision
With the parties? consent, I order as follows:
1. The Employer will arrange for the grievor to participate in an IME/FAE as soon as it can
be arranged. There will be input into the referral letter from the grievor?s Union
Representative, Mark Barclay.
2. The Union and the grievor acknowledge that the IME/FAE provider will require medical
information from the Employer concerning the grievor and that the grievor must provide
consent for the Employer to release that information to the IME/FAE provider.
3. The parties agree that a copy of the results of the IME/FAE will be provided to the
grievor?s Union representative, Mr. Barclay. They also agree that once the results of the
IME/FAE are received, the parties will reconvene to discuss future accommodation needs
based on the IME/FAE results.
4. If implementation issues arise, a conference call may be arranged.
5. I shall remain seized.
