(416) 326-1388 Tél. : (416) 326-1388 Fax (416) 326-1396 Téléc. : (416) 326-1396 GSB# 2005-0823 UNION# 2005-0234-0122 IN THE MATTER OF AN ARBITRATION Under THE CROWN EMPLOYEES COLLECTIVE BARGAINING ACT Before THE GRIEVANCE SETTLEMENT BOARD BETWEEN Ontario Public Service Employees Union (Zolnierczyk) Union - and - The Crown in Right of Ontario (Ministry of Community Safety and Correctional Services) Employer BEFOREVice-Chair Bram Herlich FOR THE UNION Tim Hannigan Ryder Wright Blair & Holmes LLP Barristers and Solicitors FOR THE EMPLOYER Simon Heath Counsel Ministry of Government and Consumer Services HEARING May 2, 2008. 2 Decision Having regard to the agreement of the parties, the Board hereby directs as follows: 1.The employer is directed to produce to the union copies of all documents upon which it intends to rely in these proceedings; and 2.To the extent there are any further documents in the employer?s possession which are arguably relevant to the matters in issue in this case, the employer is directed to provide union counsel with a list of any such documents and any disputes regarding the production of such documents may be taken up with the Board. 3.The production of any documents under the terms of this order is subject to the following conditions: (a)The documents produced are to be used only for the purposes of this matter and are not to be used for any other purpose or matter. (b)The documents produced are to remain in the possession of union counsel and, subject to the immediate needs of the instant matter, are not to be shared, copied or otherwise distributed.
