Union - and - The Crown in Right of Ontario (Ministry of Labour) Employer BEFORE Nimal Dissanayake Vice-Chair FOR THE UNION Nelson Roland Barrister and Solicitor FOR THE EMPLOYER Benjamin Parry Counsel Ministry of Government and Consumer Services HEARING May 9, 2008. 2 Decision The Board is seized with three group grievances filed by employees of the employer at its offices in Kitchener-Waterloo, Mississauga and London respectively. The three group grievances raise common issues. At the hearing on May 9, 2008, the parties engaged in discussions with my assistance, to agree upon an efficient procedure to deal with the grievances. They came to the following terms of agreement, and requested that those terms be set out in a Board decision. The agreed upon terms are as follows: 1.The Union shall identify one grievor forming part of the Kitchener-Waterloo group grievance, and also provide the employer with full particulars and disclosure with respect to that grievor?s claim, on or before June 20, 2008. 2.The employer will provide to the union full particulars and disclosure on or before August 1, 2008. 3.The hearing with respect to the grievance as it relates to the grievor referred to above shall commence on September 5, 2008, and continue on the dates scheduled as necessary. 4.In the event any disputes arise as to particulars/ disclosure or otherwise in implementing the terms herein, the parties may contact the Board to schedule a hearing by conference call before me. 5.The parties may, upon mutual consent, extend the time lines set out herein for purposes of providing particulars/disclosure. In the event of no agreement, the party seeking extension may request a hearing by conference call. 6.All of the grievances other than the one to be determined pursuant to the terms herein shall be held in abeyance until the disposition of this matter. 3 7.I shall remain seized of all of the grievances. th Dated this 12 day of May, 2008 at Toronto, Ontario.
