Union - and - The Crown in Right of Ontario (Ministry of Community Safety and Correctional Services) Employer BEFORE Felicity D. Briggs Vice-Chair FOR THE UNION Stephen Giles Grievance Officer Ontario Public Service Employees Union FOR THE EMPLOYER Gary Wylie Staff Relations Officer Ministry of Community Safety and Correctional Services HEARING June 11, 2008. 2 Decision The Employer and the Union agreed to participate in the Expedited Mediation- Arbitration process in accordance with the negotiated Protocol for grievances filed on behalf of or by Bailiffs. A number of the grievances were settled through that process. However, a few remained unresolved and therefore require a decision from this Board. The Protocol provides that decisions will be issued within a relatively short period of time after the actual mediation sessions and will be without reasons. Further, the decision is to be without prejudice and precedent. A number of the grievances that were scheduled to be heard were not dealt with because the Union had not provided particulars in advance to the Employer. The Union is ordered to do so. This information should be sent to the Employer once complied but no later than two weeks prior to our next day of hearing. It was the Employer?s position that failure to provide such particulars should result in the grievances being summarily dismissed. The grievances at issue are: GSB No. Grievor Union File No. 2002-0908 Ward, Anthony 2002-0582-0043 2003-0558 Hall, John 2003-0248-0009 2004-1784 Giraudy, Rene 2004-0234-0446 2004-1785 Giraudy, Rene 2004-0234-0447 2004-3183 Giraudy, Rene 2004-0234-0673 2004-3184 Giraudy, Rene 2004-0234-0674 2005-1906 Lehman, Gary 2005-0234-0222 2005-2437 Chmurzynski, Paul 2005-0234-0287 2005-2439 Chmurzynski, Paul 2005-0234-0289 2005-2684 Chmurzynski, Paul 2005-0234-0364 2005-2685 Chmurzynski, Paul 2005-0234-0366 2006-0873 Chmurzynski, Paul 2006-0234-0193 3 GSB No. Grievor Union File No. 2007-0973 Wellman, James 2007-0368-0072 2007-1125 Burke, George 2007-0234-0124 2007-2375 Ward, Sylvie 2007-0234-0276 2008-0526 Chmurzynski, Paul 2008-0234-0129 2008-0527 Chmurzynski, Paul 2008-0234-0130 th Dated in Toronto this 28 day of July 2008.
