Decision
The grievors complained on May 12, 2004 that they were denied the opportunity to perform
OPSEU cleaning work, instead performed by outside contractors. The employer took the
position that there had been no violation of the collective agreement. The parties referred these
grievances to mediation/arbitration in accordance with Article 22.16 of the collective agreement.
At the outset of the hearing the parties agreed that I had the jurisdiction to deal with this matter
and they asked that I issue a decision without written reasons.
Having carefully considered the submissions of the parties, as well as the jurisprudence of the
Board, I hereby dismiss these grievances.
