Albertyn Vice-Chair FOR THE UNIONDavid Wright, Ryder Wright Blair & Holmes LLP, Barristers & Solicitors Eric del Junco, Barrister and Solicitor Donald McLeod, The McLeod Group, Barristers and Solicitors FOR THE EMPLOYERLisa Compagnone Counsel Ministry of Government Services HEARINGSeptember 9, 2008. Decision 1. This decision addresses two matters. It suspends further investigation of the WDHP complaints made by grievors in these matters, and it stipulates further dates for hearing, with details of what is to occur on those dates. 2. Various grievors have filed WDHP complaints under the WDHP procedure. In most cases, if not all, the substance of the WDHP complaint will be addressed within the grievances that are before me. The parties do not wish to have a duplication of proceedings. In the circumstances, on consent, I order that any investigation of WDHP complaints by grievors whose grievances are part of this matter is hereby suspended until resolution of the grievances before me. 3. Upon this decision being issued, the Employer should ensure that each investigator affected by the above ruling is notified of the suspension of their investigation. 4. The parties will find it useful to know exactly what WDHP complaints have been filed by which grievors. To this end, the Employer is directed to provide to me (electronically) and to the Union details of each WDHP complaint that is arguably covered by the grievances that form part of this matter. As far as possible, the following details should be provided: the name of the complainant, the reference number of the complaint, the date on which the complaint was filed, and whether an investigator has been appointed, and if so, when and whom. This information should be provided within 2 weeks of the date of this decision. 5. The parties have agreed to use certain additional hearing times and, on their submissions, I assign the hearing dates as follows: September 17: 5:30pm: Charlett Thompson September 18: 5:30pm: Heather Nash October 6: 10am: Trevor Marrett October 7: 1pm: group B grievor October 8: 10am: Alnoor Vasta October 16: 5:30pm: Perry Alleyne October 28: 10am: group B grievors October 31: 10am: Charlene Tardiel November 5: 10am: Mark Brewster November 6: 10am: group B grievors 5:30pm: Mr. Small, Mr. Brewster, Mr. Dvorak November 27: 5:30pm: John Cajamarca December 1: 5:30 pm: Quincy Manor December 17: 10am: group B grievors December 18: 10am: group B grievors 2 Dated at Toronto on September 16, 2008.
