Decision
[1]In view of the fact that a T4A was mistakenly issued by Ontario Shared Services
in respect of the career-transition and counselling expenses of $2500, which was
set out at Para 1 of the Memorandum of Settlement executed on November 7,
2005, as a result of which the grievor was charged income tax on that amount, I
hereby order that the Ministry of Education contact the Canada Revenue Agency
forthwith to ascertain the status of the Ministry?s request for cancellation of the
T4A, dated March 18, 20008.
[2]I further order that the resulting information be communicated to Serge Linarello,
of OPSEU, as soon as it is obtained in order that the parties can attempt to
determine the relevant amounts and dates so that Mr. Villa can be made whole in
respect of para 1 of the MOS of November 7, 2005.
[3]In order that the relevant amounts and dates can be determined, I further order
that the grievor submit copies of any notices of assessment received from the
Canada Revenue Agency in 2007 and 2008.
[4]It is so ordered.
