Decision
[1]Having heard the submissions of the parties, the Board orders as follows:
[2]The Employer will disclose to Union counsel the following:
[3]All medical records and related photographs relating to the inmate Dennis
Churchill for the period commencing February 25, 2008 up to and including
March 9, 2008 which are in the possession or control of the Ministry. The
medical files will first be produced to Employer counsel, who will review
them and advise as to whether there are records which are not arguably
relevant in his view to the matter in issue. I will deal with any dispute as to
the arguable relevance by hearing or teleconference as appropriate.
[4]Copies of all statements provided to the Sudbury Police or statements taken
by the Sudbury Police in the possession or control of the Ministry,
including the CISU.
