Briggs FOR THE UNION Stacey Zafiriadis Grievance Officer Ontario Public Service Employees Union FOR THE EMPLOYER Gary Wylie Staff Relations Officer Ministry of Community Safety and Correctional Services HEARINGJanuary 12, 2009. 2 Decision [1]The Employer and the Union at the Toronto West Detention Centre agreed to participate in the Expedited Mediation-Arbitration process in accordance with the negotiated Protocol. Many grievances were settled through that process. However, a few remained unresolved and therefore require a decision from this Board. The Protocol provides that decisions will be issued within a relatively short period of time after the actual mediation sessions and will be without reasons. Further, the decision is to be without prejudice and precedent. [2]Rob Edwards filed a grievance alleging various violations of the collective agreement flowing from his treatment under the Attendance Support Program. [3]After hearing the facts and submissions of the parties I am of the view that the grievor must provide more information to the Employer in order for the Employer to properly consider this matter. [4]If that information is provided, the Employer will, as it should in all circumstances, review the individual facts and assess the merits of Mr. Edwards? claim. [5]Hopefully, the parties will be able to resolve the issues between them.
