Decision
[1] This award is made pursuant to the Med-Arb Protocol between the parties. The grievor
alleges harassment by Operational Manager Jim Craig at an attendance support meeting.
The allegation is corroborated by minutes taken by the Union at the meeting. The
allegation was denied by Mr. Craig. An internal investigation was conducted and no
harassment was found. The Union does not accept the results of the internal
investigation.
[2] It is clear that there remains an issue to be determined. Accordingly, I order as follows:
1)The parties, including Mr. Craig and Mr. Gardiner, are to meet, with the assistance of
an independent mediator, to try to resolve their differences. This meeting is to take
place prior to January 30, 2009.
2)If the matter is not resolved, the matter is to be referred to the Workplace
Effectiveness Board for a third party investigation.
