Decision
[1]The Employer and the Union agreed to participate in the Expedited Mediation-
Arbitration process in accordance with the negotiated Protocol for various grievances
filed by Bailiffs. A number of grievances were settled through that process. However, a
few remained unresolved and therefore require a decision from this Board. The Protocol
provides that decisions will be issued within a relatively short period of time after the
actual mediation sessions and will be without reasons. Further, the decision is to be
without prejudice and precedent.
[2]James Wellman is a Correctional Officer who filed a grievance regarding a job
competition held in 2007. He alleged that the Employer had breached the collective
agreement and that the job competition process was flawed.
[3]It was the Employer?s contention that the process was fair and appropriate and there was
no violation of the collective agreement.
[4]After hearing the facts, reviewing the documents and considering the submissions made
by the parties I must dismiss this grievance.
