Briggs FOR THE UNIONStacey Zafiriadis Grievance Officer Ontario Public Service Employees Union FOR THE EMPLOYER Gary Wylie Staff Relations Officer Ministry of Community Safety and Correctional Services HEARING January 20, 2009. 2 Decision [1]The Employer and the Union agreed to participate in the Expedited Mediation- Arbitration process in accordance with the negotiated Protocol for various grievances filed by Bailiffs. A number of grievances were settled through that process. However, a few remained unresolved and therefore require a decision from this Board. The Protocol provides that decisions will be issued within a relatively short period of time after the actual mediation sessions and will be without reasons. Further, the decision is to be without prejudice and precedent. [2]Mr. Patrick Hamel is a Correctional Officer who filed a grievance alleging that various provisions of the collective agreement were violated regarding a job competition. [3]In preparation for our med/arb session of June 11 and 12 of 2008, the Union wrote to the grievor in May requesting particulars in this matter. [4]At that session the grievor had not responded and I allowed a deferral of the matter until this session. [5]The Union again wrote to the grievor, at the address currently on file with the Employer, on August 18, 2008 asking for the facts surrounding his grievance. [6]In response to my inquiries, the Union informed me that as of January, 20, 2009, it had received no information from the grievor in this regard.
