Decision
[1]A hearing by way of telephone conference was held in this matter on March 2, 2009.
[2]Having considered the submissions of the parties and notwithstanding the union?s
objection, I hereby grant the employer?s request for an adjournment of the hearing
scheduled for March 17, 2009 in this matter. The case involves a truly impressive number
of grievances, many of which appear to relate to subject matter similar to that which is
currently the focus of an independent WDHP investigation.
[3]To be clear, neither was I asked to and I am not currently deferring these proceedings in
their entirety subject to the ultimate WDHP report. However, both parties acknowledge
that the results of that process may impact upon the instant proceedings.
[4]In the circumstances ? it appears that it may take a month or two to determine the
procedural shape and ultimate timetable of the WDHP investigation ? the parties may be
better placed to determine or, indeed, agree whether they wish to have the two parallel
proceedings unfolding simultaneously. Accordingly, I am directing that the matter be re-
listed for hearing as soon as practicable, but not earlier than 2 months from today.
[5]However, while there will be no formal hearing on March 17, 2009, the Union and the
grievor would be well advised to make productive use of that date. No particulars in
respect of the grievances have been filed. And while none have yet been formally
requested by the employer, such a request is a virtual certainty before any litigation in the
matter can commence in earnest. Accordingly, it would be most desirable if the Union
and the grievor were to make use of the March 17, 2009 date to assist in the preparation
of particulars. In that regard, I note the employer?s agreement to facilitate the grievor?s
availability for that day, even if he is otherwise scheduled to work on that day.

[6]The Registrar will be in touch with the parties with respect to the scheduling of a
continuation date.
