Decision
[1] During a conference call on Tuesday, April 7, 2009, I entertained submissions
from counsel about whether the Union is entitled to production of a document referred to as the
final audit report for the ESP program. Having regard to the submissions, I determined that the
document in question is at least arguably relevant to the proceeding and I directed that the
Employer produce the document by forwarding it to counsel for the Union before the next
hearing date, on the basis of the terms discussed during the conference call. For clarity, the
document is being produced for purposes of this proceeding and cannot be used outside of this
proceeding for any other purpose.
