Decision 1)Certain Grievors have concluded Return to Work Protocols with the Employer, either as partial, or as part of the complete, resolution of their grievances. 2)Certain concerns with the application of those Protocols have been raised with me, flowing in part from staffing changes at the Toronto Jail. 3)Under certain of the Protocols the employee is entitled to leave the workplace if they feel threatened, provided they inform management of their intention to do so. This provision must change because the person to be informed under certain of the Protocols has left the Toronto Jail and because the Employer asserts that it has, at times, not been informed of an employee?s departure. Also, the Employer does not always know of the likely duration of the employee?s absence. This makes scheduling difficult for the Employer. 4)It is therefore necessary that the Protocols be adjusted to ensure that the Employer is able to maintain regular staffing at the Toronto Jail. 5)I therefore direct the following with respect to any person who is entitled to leave work when they feel threatened under a Return to Work Protocol. In this circumstance, the employee will notify their manager that they are leaving the workplace. The notification will be in writing and, if an incident has triggered the threat, the employee will provide details of the incident so that the Employer may respond appropriately. The employee will also advise their manager when they anticipate they will return to work. If they are not able to give an accurate estimate they should indicate this, and the Employer will be entitled to assume, for the purposes of scheduling only, that they will be off indefinitely until they inform the Employer that they are able to return. 6)Nothing in this decision affects the Employer?s entitlement to require justification for medical or other absences from the workplace, unless otherwise expressly addressed in a Return to Work Protocol. th Dated at Toronto this 14 day of April 2009.
