The parties were unable to resolve the matter at mediation. Both parties agreed that it would be useful for the employer to conduct further investigation into the circumstances surrounding the agreement reached between the parties at the time with respect to the vote on the CWW. The parties have until May 1, 2009 to further investigate the matter. If, at that time, the parties reach agreement on how to proceed with the hearing, appropriate arrangements will be made. If not, I will receive submissions with respect to how the matter will be processed to expedited arbitration, i.e. whether to a hearing or by conference call, etc. and will rule accordingly. th Dated at Toronto this 29 day of April 2009.
