DECISION [1]Ms. Wendy Goring has sixty-eight grievances before the board (see Appendix 1). The parties referred these grievances to mediation/arbitration in accordance with Article 22.16 of the collective agreement. The union and the employer decided to present one competition grievance as a test case, on the understanding that the result would deal with all the grievances currently before me. The case proceeded by written submission and documentary evidence. [2]The competition was for a temporary assignment as a probation and parole officer for up to 12 months. There were two positions available. The union?s primary argument was that the employer had violated Article 6.3 of the collective agreement: since the grievor?s qualifications were relatively equal to the successful candidate, she should have been assigned to the position. The union also submitted that the employer had discriminated and acted in bad faith when it assessed the grievor?s performance in the competition. The union pointed out a number of scores that should have been higher, in its submission. The employer argued that there was no breach of the collective agreement. Further, there was no evidence to support a finding that the employer had discriminated or acted in bad faith. Finally, there was no evidence that the competition was significantly flawed to warrant an order that it be rerun. [3]The parties agreed that I had the jurisdiction to deal with this matter and they asked that I issue a decision without written reasons, in accord with the provisions for hearings under Article 22.16. - 2 - [4]Having carefully considered the submissions of the parties, as well as the jurisprudence of the board, I must conclude that there has been no violation of the collective agreement. Further, I am not persuaded that the competition was so flawed that it would be appropriate to order a remedy.
