Decision
[1]A hearing in this matter was scheduled for March 30, 2010. The parties had agreed to
utilize the day for mediation efforts. Unfortunately, by 10:30 AM on the scheduled hearing day,
the grievor had yet to make an appearance. In the circumstances, the parties agreed to adjourn
the mediation effort and to re-schedule the matter for arbitration.
[2]The employer has put the union on clear notice that should these circumstances repeat
themselves, i.e. should the grievor fail to attend at the next scheduled arbitration day, it will seek
to have the instant matter dismissed on the basis of the grievor?s failure(s) to appear.
[3]The parties are to be in touch with the Registrar in respect of scheduling the next hearing
day.
