Despite good faith efforts the parties were unable to mediate a resolution to the grievance. Instead, after a discussion with counsel, an agreement was reached regarding the steps required to ensure that this proceeding is ready for hearing. The parties agreed as follows: (a) The Employer shall by January 12, 2024 finalize its production requests to OPSEU; (b) OPSEU shall by January 19, 2024 provide the Employer with its position regarding the grievance, specifically answering the question posed by Employer’s counsel at the January 9, 2024 mediation; (c) The Employer shall provide by February 23, 2024, a statement of the facts it says are not in dispute with any supporting documents with respect to such alleged facts; (d) OPSEU shall respond by March 22, 2024, indicating which such alleged facts they are prepared to agree (or if not, what amended fact(s) they are prepared to agree to); (e) The Agreed Statement of Fact shall be finalized by April 12, 2024; (f) OPSEU shall on or before May 31, 2024 produce to the Employer the documents which it has requested or, to the extent OPSEU objects to producing a document in whole or in part, briefly state its reasons for each such objection; (g) The parties shall by no later than June 20, 2024 advise of any preliminary motion(s), outstanding production issues or any other pre-hearing issue. [2] The grievance is scheduled to proceed to a hearing on October 8, November 19, December 17, 2024 and January 15, 2025.
