Leighton Vice-Chair FOR THE UNION ice Employees Union FOR THE EMPLOYER Scott Andrews Ontario Public Serv Grievance Officer s s Greg Gledhill Ministry of Government Service Centre for Employee Relation Employee Relations Advisor HEARING March 21, 2012. - 2 - Decision [1] Mr. Monte Vieselmeyer, a Correctional Officer at the Metro West Detention Centre, filed a grievance on July 8, 2009, alleging, inter alia, that the employer breached numerous Articles of the collective agreement and the WDHP Policy. He seeks full redress. The employer submitted that there was no violation of the collective agreement and moreover that the matter was moot. [2] The parties referred these grievance to mediation/arbitration in accordance with Article 22.16 of the collective agreement. At the outset of the hearing, the parties agreed that I had the jurisdiction to deal with this matter. They asked that I issue a decision without precedent or prejudice, and without written reasons. [3] Having carefully considered the submissions of the parties, as well as the jurisprudence of the Board, I hereby deny the grievance. Dated at Toronto this 16th day of April 2012. Deborah J.D.
