MS.9 lM2 IN THE MATTER OF AN ARBITRATION Under The CROWN EMPLOYEES COLLECTIVE BARGAINING ACT Before THE GRIEVANCE SETTLEMENT BOARD Between: Mr. H. R. Barkell (Grievor) And Ministry of Revenue (Employer) Before: D. M. Beatty - Chairman G. K. Griffin - Member D. Anderson - Member For the Grievor: R. Houlahan - Ontario Public Service Employees Union For the Employer: E. C. Farragher - Ministry of Revenue Wearing: Provinces Room, Inn of the Provinces Ottawa, Ontario December 7, 1976 -2- In the grievance which he filed with this Board, Mr. H. R. Barkell who is employed in the Ministry as an Assessor 3, complained that he had been unfairly issued a letter of reprimand by his employer. That letter, written by his Manager, Mr. 0. G. MacDonald, raised certain specific allegations about the grievor's works which, in his view, indicated a certain degree of carelessness or laziness. After hearing the evidence of Mr. MacDonald in which he elaborated on the specific complaints raised in his letter, and the testimony of Mr. Barkell in which he conceded that in fact he had made certain mistakes in his work, this Board adjourned the hearing so as to allow the parties a further opportunity to discuss this matter informally with this Board and with each other. Following those discussions it was agreed that these proceedings would be terminated on the understanding that the letter issued to Mr. Barkell would stand as a valid reprimand of his work performance and would, in addition, remain on his file for a period of one year from the date of issuance. As of that date, however, it was agreed that the letter would be removed from his personnel file., So resolved, the proceedings in this matter are hereby terminated. Dated at Toronto this 21st day of December 1976. 0. M BeattY Chaikman I concur G. K. Griffin Member I concur 0. Anderson Member
