Zarudny, Counsel Crown Law Office Civil Ministry of the Attorney General June 15, 1982 -2- This matter involves a non-disciplinary discharge, where the Employer wi 1 argue that the grievor is unfit to perform his work. We met on June 15, 1982, the second, date scheduled for this matter, at which time the parties negotiated the possibility of the grievor applying for certain benefits under the, Collective Agreement. This will require the consent of a third-party,carrier. In order to allow the :parties time to have the position of the carrier, and to assess their own positions in light of the carrier's response, we adjourned until August 3, at which time we shall establish a date for the hearing, if the parties have not yet settled the matter. It should be made clear that this particular Board heard no evidence onthe merits. Therefore, we remain seized in order to ensure that a date for the hearing is established. If it proves inconvenient for this particular Board to.hear the matter, it will be satisfactory if another Board is constituted to hear the evidence and arguments.
