G ,-,. ‘I’-’ ‘1 ‘, ’ IN THE MATTER OF AN ARBITRATION BEFORE THE ,’ GRIEVANCE SETTLEMENT BOARD BETWEEN: OPSELJ (Grievances of Lessio et al) (Union and Grievers) -and- THE CROWN IN RIGHT OF ONTARIO i (MlNISTRY OF THE ENVIRONMENT) (Employer) ORDER WHEREAS the grievors named in Schedule “A” attached hereto filed classification grievances bearing the dates and GSB numbers corresponding to their names on Schedule “A”; AND WHEREAS the Employer, the Union and the Grievors have agreed, without prejudice and without precedent, to a full and final resolution of the grievances listed on Schedule “A” and have consented to an order of the Grievance Settlement Board on the following terms: 1. 2. 3. All the Grievors acknowledge that they are currently classified Trrectly as regards their bargaining unit classifications. The Employer will pay each grievor in Group 1 of Schedule “A” a sum equal to 12% of his gross earnings~ less deductions for the period he worked in the Investigation and Enforcement Branch of the Ministry up to August 31,1987. The Employer will pay to each grievor in Group 2 of Schedule “A” a fixed sum, less deductions, in the amount of $7,000 each for Mr. Hancock and Mr. Howirson, and $4,000 each for Mr. Brooks and Mr. Huggard. 4. 5. 6. 7. .The Employer will pay each grievor in Group 3 of Schedule “A” a sum equal to 12% of his gross earnings less deductions for the period from 20 days prior to their respective grievance dates through August 31, 1987. The employer will pay interest on the sums in paragraphs 2 and 4 as follows: (a) Simple interest at 11% per annum on one-half the sums in paragraphs 2 and 4 for the period up to August 31,1987; and cb) Simple interest at 11% per ,annum on the sums in paragraphs 2 and 4 for the period from September I, 1987 through December 31,199O. Provided the Union advises the Employer’s counsel of the giievors’ acceptance of this proposal prior to December 17, 1990, if payments to the grievors are not made on or before January 15,1991, interest will continue to accrue and be payable on .the same basis until the date of payment. The union and the grievors withdraw all grievances in respect of the grievors’ bargaining unit classifications. The GSB will retain jurisdictton in respect of the implementation of this order.
