The Parties hereto, without any admissions and without arejudice and precedent, agree to the following. 1. The employer agrees to revise the class staqdards for the Ambulance Officer series incorporating the respons`biIities of Basic Life Support and Advanced Life Support in both land and air based provinc;a ambulance services as applicable. 2. The employer agrees to keep the Union in4ormed of the progress of the development of these standards. 3. The employer will endeavour to complete ,.he development of the above-noted standards and to provide the Union with notice to negotiate the wages for these classes under Article 5.8 of the Working conditions and Employee Benefits Agreement within nine (9) months of the date _of the signing of this agreement, but in any event no later than twelve (12) mont.is from the date of signing this agreement. 4. The parties agree to negotiate for pay purposes only the retroactive effect of the standards for the grievors- in the above grievances. If the_parties are unable to reach an agreement on this issue, the matter of*retroa.etivity for the grievors will be referred to the Grievance Settlement Board for resolution. S. It is understood that, with this agreement, the notice under Article 5.8 with respect to the wage rates for the salary allowances for the paramedic program which was implemented effective December 1, 1985 is now void and withdrawn. 5. It is understood that the salary allowances will be deleted upon the implen*ntation of the revised class standards and the related gages. 7_ The Union and the grievors agree to witt;draw the above-noted grievant upon the Union`s receipt of notice to be_rgain the salary ranges J under Article 5.8. . zwvw i - 2 - } 8. The Union and grievers agree to adjourn sine de all hearings currently scheduled in the above grievances and to requ*st the G.S.B. not to schedule any other hearings with respect to the above grievances. 9. The,parties agree that this sgroament be made an order of the Grievance Settlement Board. FOR THE EMPLOYER FOR THE UNION A J/, h MEMORANDUM OF SETTLEMENT Between: THE CROWN IN RIGHT OF ONTARIO AS REPRESENTED BY THE MANAGEMENT BOARD OF CABINET (Ministry of Health) and THE ONTARIO PUBLIC SERVICE EMPLOYEES UNION (Employees Classified as Paramedic I & 2) RE: Bazak et al, GSB #1 013185 to 1025/85, 17.37(86, 0044188, 0315/88,'0465/88 Steve Rowland and Robert Bird, etc: (See Appendix B, attached) The parties hereto have agreed to the following terms as full and final settlement in-respect of the salary negotiations in accordance with Article 5.8 of the Ontario Public Service (OPS) Collective Agreement, for the classifications) of PARAMEDIC 1 and 2 in the Institutional and Health Care Bargaining Unit. WAGE RATES :. 1. The parties agree that the following wage rates properly reflect the wage increase as awarded by the Arbitrator, for the above-noted new classification: Group r May 30, 1991 Paramedic 1, Land 17.86 18.41 18.97 (19.54) Pafamedic 2, Land 19.02 19.61 24.20 (20.81) Paramedic 2, Air 19.98 20.59 21.21 (21.85) (Previous G23) I i Page 1 i PLACEMENT 2. Employees shall be placed at the same step in the new salary grid as the step they were at in their previous class series of Ambulance Officer 1-4, in accordance with the Employer's policy and.directive on placement on the grid, and shall retain their current anniversary dates. Also, where appropriate, the Employer will make any adjustments necessary to reflect changes in salary as a result of promotions, secondments, acting situations and/or any paid leaves of absence, in accordance with the Employer's policy and the Collective Agreement. EF ,ECTl10E,DATE 3. The effective date of the establishment of the new classification and its salary rates is May 30, 1991. FOURS OF WORK 4. The hours of work shall be as per Schedule 4-7. =y RE TROACTIVLT-Y-& INTEREST F0fJ CLAWFiCATIQN 5. The Employer agrees to compensate each grievor with full retroactivity (less required deductions) twenty (20) days prior to the filing of the grievance, plus interest in accordance with the Hallowell House Formula as agreed to by the Parties, as attached in APPENDIX A. The grievors are listed in APPENDIX B, as attached. Page 2 I 6. For the purposes of retroactive calculations, the rates of pay for the new series have been adjusted to reflect the rates of pay during the retroactive period back to 1985. The agreed upon rates for calculation purposes are set out in APPENDIX C as attached for Paramedic 1 , Land, Paramedic 2, Land and Paramedic 2, Air (Previous G23), with sample costings. It is agreed that in the calculation of retroactivity, allowances previously paid will be deducted. For purposes of calculating any overtime retroactivity, the calculations will include the differential without the allowances. Rates and retroactivity for Go Temp Employees who worked as Ambulance Officers during the period covered by this agreement, will be referred for discussion at the Go Temp Committee as per Appendix 12 of the current Collective Agreement. EENSION 7. It is agreed for pension calculation purposes duffing tl"ie`fetroactivity period, each person's annual salary computation will be adjusted for each of the applicable years, to reflect what the annual salary of each employee would have been had the salary rates been.in effect at those times. It is further agreed that the Employer shall make whatever extra payments are required for each of those years to bring the Employer's pension contributions to the level they would have been had the salary rates been in effect-at those times. The parties also agree that the Employer shall similarly deduct the employee's pension contributions for the same period from any retroactive compensation payable. DUES 8. The Employer agrees to deduct from any retroactive compensation payable to each employee Union dues at 1.325% and to remit said dues to the Treasurer of the Ontario Public Service Employees Union. The Employer agrees to refer this Memorandum to Management Board of Cabinet for approval within thirty (30) days or no later than sixty (60) days of the signing of this agreement. The Ministry will implement the new wage rates within sixty (60) days of approval by Management Board of Cabinet. Retroactivity will be calculated thereafter as quickly as possible but no later than one hundred and twenty (t 20) days after approval by Management Board of Cabinet.
